Conveyancing

 

'Conveyancing is the process of transferring the legal ownership of property or land from one person to another.'


If you are buying or selling a property, you need to instruct a conveyancer or solicitor. They will organise all the legal paperwork, for example: drawing up your contract, arranging local searches and requesting funds from your lender. A conveyancer ensures everything progresses smoothly to completion. 
 

 

The legal process of transferring property ownership is usually a two-step process:

  • Exchange of contract - the date contract details are agreed

  • Completion - the date legal titles are transferred

 

A general solicitor or a conveyancer can transfer property ownership. However, a conveyancer is a solicitor that has chosen to specialise in property law. 

 

 


Exchange of Contract 

 



If both the buyer and seller are happy with the terms, they will sign and exchange legal contracts. After exchange of contracts, the transfer is bound by law and the buyer will usually pay their deposit on exchange. 

 

 

Completion 

 



Completion is the last step in the conveyancing process. It is when the payment balance for the property is passed to the seller's solicitor and ownership transfers to the buyer.

When should I arrange a mortgage?

We recommend buyers seek financial advice early on and ideally have a mortgage in principal prior to viewing. This reassures the seller that you can finance the purchase and will put you in a stronger position than other buyers without one. 

What if I change my mind and want to pull out of my property purchase?

Both parties are allowed to pull out prior to exchange of contracts. However, following exchange of contracts, the opposing party is entitled to 'breach of contract' terms. Therefore, the seller would be able to retain a proportion of your deposit. 

Should I search for a property before I put my house up for sale?

It is good to have an idea of the kind of property you are looking for before you put yours up for sale. However, it is important to remember that you cannot secure a property until you have a buyer.
